General Terms of Use

  1. Scope

You agree that by registering, accessing, or purchasing our Consulting Journeys, you are agreeing to enter into a legally binding contract with DigitaBlue Ab (DigitaBlue). 

These Terms of Use (Terms) constitute the entire agreement between you (Buyer) and DigitaBlue.

If any part of these Terms is found to be invalid or unenforceable by applicable law, that part will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect.

The following sections shall survive the expiration or termination of these Terms:

By creating a User Account at DigitaBlue the Buyer agrees to DigitaBlue’s Data Privacy Policy. Appex 1.

  • Purchase of Consulting Journey and Access

The purchase of Consulting Journey grants Buyer access to a purchased number of User Licences. 

Each User Licence gives access to Consulting Journey for a limited time, specified in the offer and starting from the date of purchase. 

DigitaBlue provides access to the purchased Consulting Journey as soon as the payment is approved. 

  • Price

DigitaBlue has the right to change prices and offer discount vouchers and campaign prices. 

  • DigitaBlue Rights to Buyer’s Content

DigitaBlue uses reliable external partners to secure data, such as, but not limited to:

  • Atlas Mongo DB as database
  • Amazon Web Services for a multitude of services
  • Stripe for commercial services

DigitaBlue is not allowed to share the content the Buyer creates while using Consulting Journey (Buyer’s Content). 

DigitaBlue has access only to the public content that Buyer agrees to share, such as ratings, feedback about Consulting Journey, and recommendations for improvement. 

  • Buyer’s Responsibilities
  • Ownership

Buyer retains the ownership of the Buyer’s Content:  content which is created during the usage of a purchased Consulting Journey, and reports generated during using Consulting Journey.

  • Accessibility to Content

Buyer can access Buyer’s Content only during the validity of User Licence. 

  • Buyer’s User Accounts

Buyer carries the responsibility to provide and update accurate and valid email addresses for each User Account. 

Buyer carries full responsibility for its User Accounts, including for any harm or damage (to DigitaBlue or anyone else) caused by someone using User Account without your permission. Each User Account can be terminated at any time. 

  • Buyer’s Rights to DigitaBlue’s Content

Buyer has no right to resell the Consulting Journey Content (definition) in any manner (including by sharing account information with a purchaser or illegally downloading the content and sharing it on torrent sites).

  • Disclaimer

Consulting Journeys are provided on an “as is” and “as available” basis. DigitaBlue makes no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and expressly disclaims any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose. 

DigitaBlue makes no warranty that Buyer will obtain specific results from the use of the Services. Buyer uses Consulting Journeys (including any content) entirely at its own risk. 

DigitaBlue is not responsible for delay or failure of performance caused by events beyond reasonable control, like an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions.

  • Limitation of Liability

To the extent permitted by law, DigitaBlue will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability, or otherwise and even if we’ve been advised of the possibility of damages in advance. DigitaBlue liability to Buyer or any third parties under any circumstance is limited to the greater than the amount Buyer has paid in the 12 months before the event giving rise to Buyer’s claims. 

  • Governing Law and Dispute Resolution

The Agreement and the General Conditions shall be governed by the laws of Finland except for connecting factor rules. 

The Parties aim to settle any dispute arising out of or relating to the Terms by negotiations between the two Parties. Unless resolved through mutual negotiations within thirty (30) days of the date of the notice by the other Party of arising of the dispute with the other Party, the dispute will be settled by a sole arbitrator in arbitration proceedings complying with the rules of the Central Chamber of Commerce of Finland. The seat of arbitration shall be Turku and the language of the arbitration shall be Finnish. 

DigitaBlue shall in any event have the right to claim for any matured debts based on the Agreement in the lower court of the Seller’s domicile.
